Welcome to Taegyo.app (the "App"), a mobile application provided by Businessdynamite, located at ZA les terrasses de la sarre 4, 57400 SARREBOURG, France ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our App and its related services (collectively, the "Service"). By creating an account, accessing, or using our Service, you agree to be bound by these Terms.

1. IMPORTANT: Medical, Scientific, and Outcome Disclaimer

1.1. Purpose of the Application. The App and all its content (text, audio, illustrations) are provided exclusively for informational, educational, relaxation, and entertainment purposes. The Service is intended to offer a benevolent experience and a moment of relaxation and bonding for the expecting mother.

1.2. No Medical Advice. The Service is not, and is not intended to be, a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding your pregnancy or a medical condition.

1.3. Absolute No-Guarantee of Outcomes. Your use of the App is entirely at your own risk. You acknowledge and agree to the following: No Guarantee of Effect: Businessdynamite makes no warranties, promises, or claims, express or implied, regarding the results or effects of using the App. We do not guarantee any specific outcome for your child, whether in terms of cognitive development, health, behavior, or future language skills (including English).

Acknowledgment of Scientific Limits: References to scientific studies, including those provided for transparency in Appendix A, are included for informational purposes only to illustrate the concepts that have inspired the App's features. They do not constitute a warranty or proof of our specific Service's effectiveness. Individual results vary significantly and are not comparable to controlled studies.

* No Claim of Causality: A child's development is a complex, multifactorial process influenced by genetics, nutrition, environment, overall maternal health, and post-natal care. You agree that the App is a minor wellness tool and not a determining factor. Therefore, you agree not to make any claim linking the use of the App to any developmental outcome (or lack thereof) for your child.

1.4. Disclaimer of Liability for Negative Influence. By using this Service, you agree that Businessdynamite cannot be held liable for any claim that the App had an insufficient, null, or negative influence on your child's development. Any expectation of results on your part is based solely on your personal judgment and in no way engages our liability.

1.5. Voluntary Assumption of Risk. By accepting these terms, you knowingly and voluntarily assume all risks associated with the use of the Service, including the risk that it may not produce any of the effects you might personally hope for.

2. Account and Eligibility

2.1. Account Creation. To access the full Service, you must create an account using a supported third-party service (Kakao, Apple, or Google). You represent and warrant that all information you provide is accurate and that you will maintain its accuracy.

2.2. Eligibility. You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.

2.3. Account Security. You are responsible for maintaining the confidentiality of your account and are fully responsible for all activities that occur under your account.

3. Subscriptions and Payment (Conditions of Sale)

3.1. Service Model. The App is offered on a subscription basis (e.g., monthly) and via a one-time lifetime purchase. We may offer a free trial period.

3.2. Billing. All payments, subscriptions, and purchases are processed through the Apple App Store ("App Store"). You are subject to the App Store's terms and conditions for in-app purchases. All billing and transaction-related inquiries must be directed to the App Store.

3.3. Subscriptions. Monthly Subscription: Your monthly subscription will automatically renew each month unless you cancel it at least 24 hours before the end of the current billing period. Lifetime Purchase: This is a one-time payment that grants you access to the Service for as long as it is available. * Free Trial: If you sign up for a free trial, your selected subscription plan will automatically begin and you will be charged at the end of the trial period unless you cancel prior to its conclusion.

3.4. Cancellation. You may cancel your subscription at any time through your device's subscription management settings in the App Store.

3.5. Pricing Changes. We reserve the right to change our subscription plans or adjust pricing for our Service in any manner and at any time as we may determine in our sole and absolute discretion.

4. License to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use, strictly in accordance with these Terms.

5. Intellectual Property Rights

All rights, title, and interest in and to the Service, including the App's design, software, AI-generated content, audio files, text, graphics, illustrations (including the "My Garden" feature), and branding, are and will remain the exclusive property of Businessdynamite and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Service or its content.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, national, or international law.

  • Reverse-engineer, decompile, or otherwise attempt to discover the source code of the App.

  • Interfere with or disrupt the integrity or performance of the Service.

  • Use the Service in any manner that could be harmful to a fetus or pregnant woman (e.g., using the device at an excessively high volume), acknowledging that excessive noise can be a prenatal stressor.

7. Termination

You may terminate this agreement at any time by deleting your account through the Settings screen in the App. We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including if you violate these Terms.

8. Disclaimers of Warranties & Limitation of Liability

8.1. "AS IS" Service. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BUSINESSDYNAMITE, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONTENT OBTAINED FROM THE SERVICE; (III) ANY CLAIM WHATSOEVER RELATED TO THE EFFECT, LACK OF EFFECT, OR UNWANTED EFFECT OF THE SERVICE ON THE PREGNANCY, FETUS, OR CHILD'S DEVELOPMENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF BUSINESSDYNAMITE EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE PAST TWELVE MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Sarrebourg, France, to resolve any legal matter arising from these Terms.

10. General Terms

10.1. Entire Agreement. These Terms and their appendix constitute the entire agreement between you and Businessdynamite regarding the use of the Service.

10.2. Language. The governing language of these Terms is English. Any translations provided are for convenience only.
